REPORT & FINAL OUTCOMES

A report was presented to the Asset Management Committee on Monday 15 November 2021 and the following motion was endorsed by Council on Monday 22 November 2021.

Motion

  1. That the Model T Ford Club is offered a ten year licence over the Port Road median clubrooms, comprised of consecutive five year terms, with the Agreement to be executed under existing delegations.

Council will now execute the lease by delegation.

Community Feedback & Report

Council staff are currently reviewing feedback and preparing a report to be presented to the Asset Management Committee.

An update will be provided for the meeting once the report has been finalised.

Background Information

The Model T Ford Club have occupied the clubrooms located in the median strip of Port Road, Croydon, for 30 years. In that time the Club have established themselves as reliable tenants and have worked with the Council to maintain and improve the asset. They have, by prior arrangement, increased use of the Clubrooms substantially and now share the premises with a number of hobbyist and interest clubs.

The asset is located on land which is owned by the Minister for Infrastructure and Transport but has been transferred into the care and control of the City of Charles Sturt (Council). Importantly, the land is subject to a Dedication on which means it is to be treated as Community Land rather than local government land. The tenant has requested a 10 year term as a five year initial term and five year renewal, effective from 1 September 2021 to 31 August 2031, in support of capital works they have planned and funded for the site.

The Local Government Act, 1999 sets out that when Community Land is alienated by Lease or Licence for a period of more than 5 (five) years, the community must be consulted.

A report was presented to the Asset Management Committee on Monday 21 June, 2021 to commence community consultation.

Community Consultation

We are now seeking your feedback regarding the formal application received seeking an extension of the existing Licence term for a period of 10 years, drawn as two consecutive five year renewals. No change to activity, nor the times or area of activity are proposed.

As directed by Section 202 of the Local Government Act, 1999, community consultation must be undertaken where the proposed alienation of land extends for a period of more than five years.
